Disputes and Arbitration
Hop Nepal is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you or we may pursue claims as explained in this section.
To give us an opportunity to resolve informally any disputes between you and us arising out of or relating in any way to the Website, these Terms of Use, our Privacy Policy, any services or products provided, any dealings with our customer service agents, or any representations made by us (“Claims”), you agree to communicate your Claim to Hop Nepal by contacting Hop Nepal Customer Support or calling (02) 9171 8861. You agree not to bring any suit or to initiate arbitration proceedings until 60 days after the date on which you communicated your Claim to Customer Support have elapsed. If we are not able to resolve your Claim within 60 days, you may seek relief through arbitration or in small claims court, as set forth below.
You and Hop Nepal agree that any and all Claims will be resolved by binding arbitration, rather than in court, except that you and we may assert Claims on an individual basis in small claims court if they qualify. This includes any Claims you assert against us, our subsidiaries, travel suppliers or any companies offering products or services through us (which are beneficiaries of this arbitration agreement). This also includes any Claims that arose before you accepted these Terms of Use, regardless of whether prior versions of the Terms of Use required arbitration.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including statutory damages, attorneys’ fees and costs). The arbitrator must follow and enforce these Terms of Use.
Arbitrations will be conducted by the Australian Centre for International Commercial Arbitration (ACICA) under its rules, including Australian Consumer Rules. Payment of all filing, administration and arbitrator fees will be governed by the ACICA’s rules, except as provided in this section. If your total Claims seek less than $10,000, we will reimburse you for filing fees you pay to the ACICA and will pay arbitrator’s fees.
Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated, or representative action. The arbitrator will have authority to decide issues as to the scope of this arbitration agreement and the arbitrability of Claims. If for any reason a Claim proceeds in court rather than in arbitration, you and we each waive any right to a jury trial.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your Claims to “Hop Nepal: Arbitration Claim Manager,” at Hop Nepal, 109 West Botany St, Arncliffe 2205, Sydney, Australia. If we request arbitration against you, we will give you notice at the email address or street address you have provided. The ACICA’s rules and filing instructions are available at https://acica.org.au/arbitration-rules/.
Validity, Prices, and Goods and Services Tax (GST)
All prices stated on this website are in US currency. Prices are subject to change without notice in the event of fluctuations in exchange rates or increases in airfares or supplier costs outside the control of Hop Nepal. However, no surcharges will apply once final payment has been received. Most of the overseas products featured on this website are exempt from Australian GST. However, due to legislation, GST is applicable on all domestic services provided, such as cancellations, amendments, visa processing, etc.
Deposits and Balance Due
To secure a booking, a 20% non-refundable deposit will be required for all services within 7 days from the booking date. For all tours and services, final payment is required 60 days before commencement of your travel arrangements.
Payments
Payments may be made by direct deposit or credit card (Visa or MasterCard). A merchant fee of 1.5% for Visa and MasterCard is added to any payments processed using these methods.

Service Fees, Cancellations, and Refunds
All bookings are final and cannot be changed, refunded, exchanged, or transferred to another party. Your credit card will be charged for the amount shown even if you do not use the booking. No refunds are available for cancellations once travel arrangements have commenced or “no-shows” due to personal negligence or choice. Hop Nepal does not authorise any overseas supplier or hotel to promise refunds on our behalf. All claims for refunds or reimbursements must be received in writing within 3 weeks from the date the service was provided.
For cancellations occurring prior to commencement of the booking, the following penalties will apply:

Visa Costs: Applying for visa service will include the total visa cost + $50 (service charge). The visa cost is non-refundable once it is purchased or following issue. Airline tickets, accommodation and tours bookings which have been issued are subject to cancellation fees imposed by the vendors.
Tour conditions & Special Requests
The services we provide are suitable for almost anyone and age is seldom an issue. An eagerness to be involved and a positive approach to travel will result in a satisfying and rewarding holiday. However, it is your responsibility to ensure that you have a suitable level of fitness to undertake your chosen travel itinerary and you must inform Hop Nepal of any medical condition that may prevent your full participation. If a re-routing of a tour is required, Hop Nepal will cover any additional costs associated with those changes within the dates of the particular tour. Any other changes (e.g., airline changes) which result in additional hotel nights, meals or other services are the responsibility of the passenger. Hop Nepal should be advised at time of booking of any dietary requirements or special requests, such as meals, bedding preferences, non-smoking rooms, etc. Whilst we cannot guarantee, we will endeavor to honor these requests when possible.
Passports & Visas
All customers must hold a current passport which must be valid for at least six months after your departure. It is the responsibility of the individual to obtain the required visas prior to departure or at the Nepal Airport. If an individual requires Hop Nepal to apply for a visa to Nepal, as that individual you will be required to pay the full cost of the visa along with any service charges.
Responsibility
Hop Nepal is an intermediary and acts only in the capacity of an agent for passengers in all matters related with booking flights, accommodation, and tours. All receipts, tickets, or vouchers are issued subject to the terms and conditions under which services are provided. Hop Nepal assumes no responsibility for loss, injury, accident, delay, damage, or irregularity that may be caused to person or property, regardless of cause or arising during any tour under its management, sponsorship, or procurement. Travelers acknowledge that reasonable changes may be made, and it is the responsibility of the passengers to make sure that they are in possession of the proper travel documents.
Reliance on Information
The information on this Website is provided in good faith, however, you should not rely on it without making your own independent assessment of the information. To the extent permitted by law, Hop Nepal offers no warranty as to the accuracy, currency, reliability, or completeness of any information contained on this site.
